Ex-Yanks' drug use likely out of Clemens trial (AP)

WASHINGTON ? The federal judge who will preside over Roger Clemens' perjury trial said Tuesday he probably will not permit the pitcher's former teammates on the New York Yankees to give testimony aimed at bolstering the credibility of Clemens' former trainer, now a major prosecution witness.

A day before the trial's start, U.S. District Judge Reggie Walton said at a hearing that statements from former Yankees Andy Pettite, Chuck Knoblauch and Mike Stanton that they received injections of performance-enhancing drugs from the trainer, Brian McNamee, could unfairly influence jurors.

Clemens is charged with perjury, false statements and obstruction of Congress for telling a House committee under oath that he never used steroids or human growth hormone during his 23-season career. The record-setting pitcher who once seemed a sure bet for baseball's Hall of Fame now could face prison if 12 jurors agree that he lied and unanimously agree to convict him.

Walton also said he is inclined to prevent Clemens' defense team from telling jurors about rape allegations against McNamee that did not result in charges. Rusty Hardin, Clemens' lead attorney, told Walton that the alleged rape is "inextricably bound to this entire case."

Clemens' main defense has been to discredit his former friend McNamee. Walton said Tuesday that telling jurors about an alleged rape that did not result in charges would be "extremely prejudicial," although he did not make a final ruling on these issues.

He also warned of a possible delay in the trial concerning the inability to obtain the audio of Clemens' deposition to House investigators in 2008. Both sides want the audio to be played in court, but the House office in charge of transcribing testimony has refused to part with the audio. However, a transcript is available.

The trial of the United States vs. William R. Clemens, expected to last 4-6 weeks, will bring a parade of celebrity athletes and plenty of sordid details to the staid Washington federal courthouse. It will feature testimony about illicit drugs, bloody evidence of injections, an abscess on Clemens' backside allegedly caused by steroid use and the allegations that his accuser is a serial liar and a rapist.

Clemens isn't the only all-star baseball player to be criminally charged with lying about drug use, and prosecutors have a mixed record. Infielder Miguel Tejada pleaded guilty in 2009 to a misdemeanor for withholding information about an ex-teammate's use of drugs when questioned in 2005 by congressional investigators. But in their first jury test, prosecutors were able to convict home run king Barry Bonds of just one count of obstruction of justice in April for giving an evasive answer to a grand jury when asked about drug use. The jury deadlocked on the three remaining counts that Bonds made a false statement by saying he never knowingly received steroids and human growth hormone from his trainer.

But unlike the Bonds trial, where the trainer who allegedly provided injections refused to testify against his former boss and friend, McNamee is the prosecution's leading witness.

Other players were allowed to testify about drugs they received from Bonds' trainer because of his absence from the trial. But Walton said Tuesday that Clemens' prosecutors would not face that problem, leading him to believe that other players' dealings with McNamee are not relevant to Clemens' case.

Even with some former teammates' testimony disallowed, Pettitte remains particularly important because he's the only witness besides McNamee who says he spoke with Clemens about his drug use.

For a decade, McNamee worked out intensively with Clemens and helped shape "The Rocket" into one of the most powerful pitchers in the major leagues, even into middle age. McNamee also says he injected Clemens with steroids and human growth hormone, and even kept the used needles that will be key scientific evidence at trial.

But McNamee, a former New York City police officer, is not an ideal witness for the prosecution. He acted as a drug dealer to several major league players and acknowledges he hasn't always told the truth when asked about Clemens' drug use and other matters. McNamee initially denied giving Clemens drugs, he says out of loyalty to his best and longtime client, but eventually admitted to federal agents that he injected the seven-time Cy Young Award winner.

Clemens' attorneys described McNamee in a recent court filing as "the only person in the entire world who has ever alleged that he witnessed Mr. Clemens use performance enhancing drugs at any time in his storied career."

Clemens' lawyers accuse McNamee of being a "congenital liar" who made up the allegations against their client to save himself from drug charges. They also want to introduce evidence that in 2001 McNamee drugged and raped a woman, then lied to police who investigated the allegation but never charged McNamee with a crime.

The six felony counts against Clemens stem from the House Government Reform Committee's 2008 investigation into the use of performance-enhancing drugs in baseball. Former Sen. George Mitchell had recently published a 400-page report that named Clemens and 85 other former and current major league players as users. Clemens denied the allegations and the House committee responded by opening an investigation into the dispute surrounding the Mitchell Report.

Clemens appeared voluntarily before committee staff for a deposition under oath on Feb. 5, 2008, in which he flatly denied ever using anabolic steroids or human growth hormone.

Eight days later at a public hearing, he continued to insist he never used performance-enhancing drugs. The indictment accuses him of making 15 separate false statements during both the deposition and hearing testimony, including denials of drug use, insistence that Pettitte must have misheard him about using drugs and denials that he attended a party at admitted steroid user Jose Canseco's house.

The six charges Clemens is accused of carry a maximum sentence of up to 30 years in prison and a $1.5 million fine. But it would be unlikely even if he were convicted that Clemens would be sentenced to nearly that long since he doesn't have a criminal record.

Nearly 200 rhinos killed this year in South Africa: WWF (AFP)

JOHANNESBURG (AFP) ? Nearly 200 rhinos were killed in South Africa in the first half of 2011, with most slaughtered in the world-famous Kruger National Park, environmental group WWF said.

South Africa lost 193 rhinos in the first six months of the year, with 126 of them killed in Kruger, one of South Africa's top tourist draws, the group said in a statement.

Last year a record 333 rhinos were killed in South Africa, which is home to about 70 percent of the world's rhino population.

"Poaching is being undertaken almost without exception by sophisticated criminals, sometimes hunting from helicopters and using automatic weapons," said Joseph Okori, WWF's African rhino programme coordinator.

"South Africa is fighting a war against organised crime that risks reversing the outstanding conservation gains it made over the past century."

South Africa's success in conservation has made the country a target for well-armed gangs. The military this year has begun patrolling Kruger in an effort to crackdown on poaching.

Authorities have arrested 123 suspected poachers so far this year, with six convictions. But the stepped-up law enforcement efforts have yet to slow the slaughter.

Poaching has soared from just 13 cases in 2007, an increase powered by demand for rhino horns in Asian traditional medicine.

"We are pleased to see more successful convictions of poachers," said Morne du Plessis, head of WWF South Africa.

"Applying strict penalties for wildlife crimes such as rhino poaching will demonstrate the South African government's commitment to maintaining this important part of the country?s heritage."

New US policy aids workers abused by diplomats (AP)

SILVER SPRING, Md. ? Employed by a Kenyan diplomat, Beatrice Oluoch followed her boss to America expecting to continue her comfortable nanny position at reasonable pay. Instead, Oluoch says she was made to work 13-hour days, denied overtime pay and barred from leaving the house. She cooked and cleaned during the day and says she was on-call round-the-clock for her employer's two young children.

Her salary? $150 a month.

She felt isolated and feared retaliation, anxious if she publicly reported the mistreatment she could be fired, lose her visa and get deported. So she ran off with a friend and is now suing her powerful boss for human trafficking and labor violations, hoping a new federal policy will give her time to remain in the country as she applies for a new visa and pursues her abuse claims in court.

"Right now, if I go back (to Kenya) I am not a free person," she said recently.

The policy change, announced by U.S. Citizenship and Immigration Services in March, permits former employees of diplomats who are suing their bosses to remain in the country and legally work while their cases are pending. Lawyers and advocates say the change, though unlikely to result in a wave of new lawsuits, eases the deportation threat for abused workers who have fled their jobs and lost their visas while enabling them to move out from society's margins as they report mistreatment.

The change comes as part of a concentrated federal effort to fight human trafficking.

"For us, it's exciting because it does remove barriers to people coming forward if they do have valid allegations of this type of abuse," said Luis CdeBaca, a State Department ambassador responsible for combating human trafficking.

Oluoch arrived in Bethesda, Md., on a visa in July 2006 to serve as a nanny to Stella Kerubo Orina, who at the time worked for the Kenya Mission to the United Nations. Oluoch said she had worked for her in Kenya without problems, but the job in America immediately deteriorated.

She said she was perpetually on call to her boss's two young children, could not use the telephone, suffered verbal abuse and had her passport confiscated. Though her initial contract guaranteed her $8 per hour, she said she was paid just $150 one month and $50 the next, with the remaining $100 sent to her family in Kenya.

Oluoch's lawyer, Aaron Uslan, likens his client's employment to slavery and says Oluoch stands to directly benefit from the new policy.

"How can you receive due process, how can these people avail themselves of the judicial system if they're deported back to their home country?" Uslan asked. "Diplomat wins again. Not only do they have immunity, but they're disadvantaged by the fact that these victims are deportable."

Oluoch fled in September 2007 and found refuge with friends in Frederick, Md., where she remains. But since her visa has been terminated, she is here illegally.

Orina has left her post and now works in Nairobi with the Kenyan Ministry of Foreign Affairs. She is on leave there until mid-July and did not respond to phone messages that officials there agreed to forward.

The policy change applies to holders of specific visas, known as A-3 and G-5, which are issued to foreign employees of ambassadors, diplomats and consular officers ? workers who often are poor, uneducated and susceptible to abuse. Because the visas are tied to their employment, once workers leave their job, they lose their visa ? and with it, their legal right to stay in the country.

Olouch is in the process of applying for a T visa, which is available for human trafficking victims who cooperate with law enforcement in criminal investigations. But those visas are hardly guaranteed. The application process is cumbersome and time-consuming, some allegations may not meet the human trafficking threshold and some victims may be hesitant to cooperate with authorities. That difficulty, lawyers and advocates say, is why the new protection is so critical.

"You've got the language barriers, the fear, the not understanding how things work in the U.S. It could be that they're from countries where police are corrupt," said Janie Chuang, a professor specializing in human trafficking at American University's Washington College of Law. "You worry about retaliation, you worry about what's going to happen to your family members."

Though the policy allows workers to stay while they seek compensation, there's no guarantee they'll be able to remain once the case ends. Some workers may be eligible for special visas for human trafficking victims, but many others may have no path to permanent citizenship. The lawsuits themselves are hardly slam dunk cases, either. Diplomats generally enjoy some level of immunity shielding them from court action, with some critical exceptions ? such as if a foreign government waives the immunity or the diplomat has changed posts.

A 2008 Government Accountability Office report identified 42 foreign workers since 2000 who reported being abused by diplomat bosses in the U.S., but said the number is probably higher, in part because of workers' fear of making public complaints. Federal agencies looked into 17 of the cases for human trafficking, visa fraud or labor violations; of the remaining 25 employees, nine resulted in lawsuits.

Some cases do, however, result in criminal charges. Last week, an Italian government worker posted at the San Francisco consulate and his wife were arrested and charged with turning a Brazilian woman into an indentured servant. The couple denies the allegation.

The new policy derives from the 2008 reauthorization of a federal anti-trafficking law, which directed the Department of Homeland Security to permit visa holders to remain in the country long enough "to fully and effectively participate in all legal proceedings." The protection lasts for a year but can be extended.

"While people can sue from abroad, there is so much work that has to be done in person," said Cindy Liou, an attorney with Asian Pacific Islander Legal Outreach, which helps human trafficking victims. "Having this option and being able to get this work done more quickly without having to rely on law enforcement is, again, a very empowering thing for a client."
